Victoria Playpark Terms & Conditions

1. Enrolment:
Admission to Victoria Playpark (henceforth “VPP”) will only be confirmed upon registration.

Enrolment in VPP does not guarantee admission to any Victoria Educational Organisation’s Pre-Nursery or Kindergartens.

2. Payment:
Registration fee must be paid upon enrolment and re-enrolment of our playgroup programme. For the avoidance of doubt, returning child who withdrew from our programme previously will be required to pay the registration fee in full upon readmission.

Tuition fees are calculated based on number of classes to be held each month according to our calendar. Our latest calendar is available at www.victoriaplaypark.com.

Tuition fees for the first month shall be settled upon registration, and tuition fees for any subsequent month shall be paid in advance on or before the 10th day of every month. If VPP centre is closed on the 10th day of the month, such payment shall be made on the next day on which VPP centre re-opens. In the event that any tuition fee is not paid in a timely manner, VPP may charge you a fee of HK$100 for late payment, and reserves the right to suspend your child’s attendance in our programme, terminate this contract with you, and offer your place to another child.

Save for VPP closure of business and cancellation/termination of our programmes under clause 15 of these Terms and Conditions, all fees paid are non-refundable and non-transferrable.

3. Sickness:
If your child feels sick or shows symptoms of any disease or communicable disease, please keep your child at home and inform VPP directly by phone or email as soon as practicable. Your child should only return to class after recovering from any contagious diseases as evidenced by a medical certificate. If your child and/or his/her accompanying parent/ caregiver show any symptom of sickness or have body temperature over 37.5 °C or 99.5 °F, VPP shall have the right to request him/ her to leave the centre to safeguard the health and safety of all other children and parents/ caregivers.

4. Make-up Class:
(a) Absence due to sickness
If your child cannot attend a class, please inform VPP directly by phone or email before the class. A maximum of one make-up class at the same level will be provided for each calendar month (i.e., a period commencing from the 1st day of any month and ending on the last day of that month, but excluding any inclement weather conditions) for absence due to sickness. No make-up class will be provided for any other absence.

Should you need to apply for a make-up class, please submit a written request together with a medical certificate as soon as possible. Unless receipt of your request, VPP shall have no responsibility to schedule any make-up class with you. Any make-up class must be arranged and completed within the next 30 days from the sick leave. VPP may not be able to guarantee alternative or available timeslots that fit your or your child’s schedule. Once the date and time of the make-up class has been mutually agreed, no subsequent change can be made. If your child is unable to attend any agreed make-up class, save for VPP closure of business under clause 15 of these Terms and Conditions, no refund or additional make-up class will be offered.

(b) Class Suspension
In the case that VPP suspends any class due to any events or circumstances beyond the control of VPP and parents (including without limitation, spread of infectious diseases, any law or action taken by the government or public authority, but excluding any inclement weather conditions), VPP shall not be in breach of this agreement nor liable for delay in performing, or failure to perform, any of its obligations under this agreement and any tuition fees paid for the missed classes will be carried forward and used for future classes of the same timeslots. If your child does not enroll the future classes of the same timeslots for whatever reason (other than due to VPP closure of business and cancellation/termination of classes of the same timeslots as described under clause 15 of these Terms and Conditions), no refund or additional make-up class will be offered.

5. Withdrawal:

Withdrawal from our programme must be made by submitting VPP’s withdrawal notice form to VPP centre by email or post, or in person and the last day of your child’s enrolment will be the last day of the following month after our receipt of your withdrawal notice form. For example, if VPP receives your withdrawal notice form on 15 February, the last day of your child’s enrolment will be 31 March.

Save for VPP closure of business and cancellation / termination of our programmes under clause 15 of these Terms and Conditions, any fees paid are non-refundable and non-transferrable if your child is withdrawn before completion of any class.

Unless VPP has received your completed withdrawal notice form in accordance with these Terms and Conditions, your child’s enrolment in our programme and your contractual obligations here under (including payment) shall continue.

6. Accompanied by an Adult:
Each child must be accompanied by an adult at all times when attending our programme. VPP accepts no parental responsibility for your child and the accompanying adult should be able to ensure safety of the child within our premises. Only one adult per child is permitted into our premises. It is suggested that a child is accompanied by a parent or his/ her primary caregiver to ensure that the child feels safe in a new environment.

7. Attire:
All playgroup children must wear VPP aprons and indoor shoes during classes. All personal items should be clearly labelled with your child’s name. Children should not wear necklace, bracelet, trinket or other similar ornaments as such can be potentially dangerous and VPP will not be responsible for any losses or injuries caused by these ornaments. Additional aprons and school bags can be purchased from VPP and the prices are not covered in the tuition fees. Accompanying adults are required to wear clean socks within our premises.

8. Health and Safety:
(a) VPP reserves the right to introduce new health and safety measures at any time and change any existing measures from time to time subject to prevailing needs to safeguard the health and safety of all children and parents/ caregivers.
(b) Medical Declaration and Disclosure: Parents must complete the confidential “Medical Record and Authorization for Emergency Situations Form” upon registration to disclose full details of any known medical condition, health problem or allergy/ dietary restriction, or any concerns about the child’s health and safety to VPP. Parents should also update the centre in writing as soon as practicable, if the child develops any known medical condition, health problem or allergy/ dietary restriction, becomes unable to take part in any activities or has contracted any infectious disease.
(c) Illness / Accident at our premises: In the event of illness or accident at our premises requiring medical attention, VPP will try to contact the designated emergency contact person and/ or the parents of the child who is accompanied by his/her caregiver immediately.
(d) Parents acknowledge that our programme may include activities where your child will learn with food:
i. your child may use various kitchen utensils, equipment, and small appliances;
ii. the teacher may demonstrate with kitchen equipment/ appliances and use cooktops as well as the oven;
iii. your child may handle raw, cooked and processed food items which may contain allergens including but not limited to meat, nuts, dairy, gluten, and other food ingredients; and
iv. we will assume your child does not have any dietary restriction, allergy or other medical conditions unless we have been notified in writing.
(e) VPP shall not be held liable for any and all losses, injuries, claims, damages and liabilities arising from or related to the child if parent has not disclosed or notified us the child’s dietary restriction, allergy or other medical conditions in writing.

9. Student and Parent/ Caregiver Badges:
Each child and accompanying adult should wear a badge provided by VPP at all times in our premises.

10. Personal belongings:
Accompanying adults shall be reminded to take care of their personal belongings in our premises. Accompanying adults using the lockers shall be reminded to properly keep the keys. In case of missing keys, VPP reserves the right to open the locker in the presence of the concerned accompanying adult. All expenses incurred therefrom shall be borne by such accompanying adult.

11. Photos, Video and Audio Recordings:
Photo taking, audio recording or video recording is prohibited in our premises except taken by VPP staff.

Photographs and video/audio recordings taken by VPP may be used for our promotional purposes, including our brochures, newsletters, social media and website: www.victoriaplaypark.com. Some of the materials may be used internally, for example, for our staff training or record purposes. Parents who do not agree to this must inform VPP in writing through the “Parent/ Guardian Consent Form” upon registration or by email/ letter if there is subsequent change of preference.

If a Red/Black Rainstorm Warning Signal / Tropical Cyclone Warning Signal No. 3 or above is issued during lessons, parents and children should stay in the centre. We will advise parents and children to leave the centre only when it is safe.

There will be no make-up classes, rescheduling or refund for any cancelled classes as a result of the inclement weather conditions as outlined above.

VPP reserves the right to make different arrangements for individual centre to ensure safety of parents and children.

13. Security: Closed-circuit Television (CCTV) System:
A CCTV system has been installed on centre with cameras at prominent locations. For the overall safety of the centre and personal safety of the children, such CCTV system will record the video footage which will be handled in compliance with the Personal Data (Privacy) Ordinance (PDPO) and any applicable laws in Hong Kong. Any collection, retention, disclosure, transfer and use of any personal data shall comply with our Privacy Policy which is made available at our website at https://www.victoriaplaypark.com/.

Victoria Playpark respects personal privacy of each individual and will not disclose or transfer the video footage to any third party unless each individual recorded in such video footage gives an express consent to us or if any applicable exemptions under the PDPO apply (e.g., VPP may, in accordance with the exemptions under section 58(2) of the PDPO, disclose the information to the law enforcement agencies for the prevention or detection of crime). Any data access request must be made to the Centre Head in accordance with the PDPO. Please note that the Centre Head shall or may refuse to comply with a data access request in the circumstances specified in section 20 of the PDPO.

14. Limitation of Liability:
To the maximum extent permitted by law, VPP and all our employees, directors, officers, agents, shareholders and affiliates shall not be held liable for any and all losses, injuries, claims, damages and liabilities arising from or related to the child’s attendance at VPP or use of the centre’s facilities, other than any liability for death or personal injury resulting from negligence by VPP or its employees, directors, officers, agents, shareholders or affiliates. Our liability to you for loss or damage of any kind (including loss or damage caused by negligence) is reduced to the extent that you caused or contributed to that loss or damage.

15. Refund policy:
(a) VPP reserves the right, at our sole discretion, to vary, cancel and terminate any of our programmes and services provided. In the case that VPP cancels or ceases to continue any programme, we will let you know at least 14 days in advance of our cancellation or cessation of any programme, and offer any alternative arrangements (if any) to you. If all alternative arrangements are refused, we will refund the tuition fee received in full (where such cancellation is made prior to the commencement) or on a pro-rata basis (where there is any class paid but unattended until cessation).
(b) In the case of VPP closure of business permanently prior to the commencement of any programme, we will refund in full all the tuition fee received in respect of such programme to you.

With regards to refund procedure, we will inform the child’s parent/ guardian of refund arrangements in writing (e-mail, fax or letter); and issue a refund receipt which the child’s parent / guardian is required to sign to acknowledge receipt of the refunded amount.

16. Miscellaneous:
(a) All our materials and curriculum information are strictly limited to current enrolled students at VPP. Reproduction of our materials in any form is strictly prohibited.
(b) We have a strictly no gifts policy in place at our centre for staff members.
(c) You are not permitted to hire our staff to provide private tutoring for your child.
(d) You agree to indemnify and hold VPP and our directors, officers, employees, consultants, advisers and agents harmless from any and all claims, liabilities, costs, damages, losses and expenses, including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other professional costs and expenses, suffered or incurred by any of us arising out of or in connection with your breach or violation of any applicable laws and regulations or of any of these Terms and Conditions. This indemnity does not apply to the extent that it is proved that any claims, liabilities, costs, damages, losses and expenses are direct and reasonably foreseeable arising directly and solely from our negligence or wilful default or that of our directors, officers, employees,
consultants, advisers and agents. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.
(e) Each provision in these Terms and Conditions shall be construed separately as between you and us. If any of the provisions is held to be invalid, illegal, unenforceable, or incapable of performance but would be valid if some part thereof was deleted such provision shall apply but with such modification as may be necessary to make it valid, legal and enforceable.
(f) VPP reserves the right, at our sole discretion, to modify, amend, add or remove any of these Terms and Conditions and any of our programmes and services at any time and from time to time, save and except that we will give 30 days prior notice to you if we consider that such modification, change, addition and removal of these Terms and Conditions and our programmes and services are material. Such modification, change, addition and removal will be effective when it is posted on our website or sent to you. Your continued engagement with us after any changes to these Terms and Conditions are posted or sent will be deemed acceptance of those changes.
(g) Save that any member of VPP may enforce these Terms and Conditions, a person who is not a part to this contract shall not have any right to enforce any terms of this contract or have any benefits under this contract. Subject to the immediately preceding sentence, application of the Contracts (Rights of Third Parties) Ordinance (Chapter 632 of the Laws of Hong Kong) is expressly excluded.
(h) This contract shall be governed by and are to be construed in accordance with the laws of Hong Kong. Any dispute controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be submitted to the exclusive jurisdiction of the Hong Kong courts.
